February 2017 - Key Highlights of Union Budget 2017

Real Estate
  • Capital gains on account of entering into JDAs to arise in the year of project completion
  • Holding period for determination of long term nature of capital gains on sale of immovable property, reduced from the existing 3 year period to 2 years
  • Relief for real estate developers from charging to tax of notional rental income (under the head 'income from house property') on unsold inventory, for one year from the end of the financial year in which the completion certificate is obtained
  • Built up area thresholds for qualifying as an affordable housing project (eligible for 100% profit linked deduction) has been amended to 30/ 60 sq meters 'carpet area' for metro and non-metro cities respectively (vis-a-vis built up area)
  • Base year for considering indexation benefit while computing capital gains shifted from 1 April 1981 to 1 April 2001 - accordingly, fair value as at 1 April 2001 to be the base for calculating indexation
  • Tax rate for companies with annual turnover upto INR 50 crores reduced to 25%
  • Conversion of preference shares into equity shares has been exempted from capital gains tax
  • MAT credit allowed to be carried forward up to a period of 15 years (vis-vis 10 years at present)
  • Scope of domestic transfer pricing restricted to only if one of the entities involved in related party transaction enjoys specified profit-linked deduction
  • Concessional withholding rate of 5% on interest paid on ECBs/ RDBs extended till 30 June 2020
  • Prohibition of cash transaction above INR 3 lakhs, subject to certain exceptions
General
  • Income Tax rate cut to 5 pc for individuals having income between Rs 2.5 lakh to Rs 5 lakh
  • 10 pc surcharge on individual income above Rs 50 lakh
  • 15 pc surcharge on income above Rs 1 cr to continue
  • Allocation under MNREGA increased to 48,000 crore from Rs 38,500 crore. This is highest ever allocation
  • Rs 9,000 cr higher allocation for payment of sugarcane arrears
  • Target of agriculture credit fixed at Rs 10 lakh cr in 2017-18
  • Tax administration honouring the honest is one of the 10 pillars of Budget 2017-18
  • Two new AIIMS to be set up Jharkhand and Gujarat
  • New rules regarding medical devices will be devised to reduce their cost
  • 1.5 lakh health sub centres to be converted to Health Wellness Centres
  • National Housing Bank will refinance individual loans worth Rs 20,000 crore in 2017-18
  • Rs 500 cr allocated to set up Mahila Shakti Kendras; Allocation raised from Rs 1.56 lakh cr to Rs 1.84 lakh cr for women and child welfare
  • Relaxation in norms for Start Ups for getting tax exemption
  • Excise duty on pan masala containing tobacco (Gutkha) raised to 12 pc from 10 pc
  • Excise duty on non-filter cigarettes of length not exceeding 65 mm raised to Rs 311 per thousand from Rs 215 per thousand
